В Волгограде прокуроры пошли в пивные ларьки
За текущую неделю в Волгограде десятки владельцев киосков подверглись проверке прокуратуры. Как сообщила ИА «Высота 102» председатель отделения ВРО «Опора России» по Центральному району города Лариса Мельникова, во всех случаях надзорный орган выносит постановления о привлечении коммерсантов к административной ответственности за якобы незаконную продажу пива в ларьках, размещенных на остановках общественного транспорта. Основанием служит принятый 18 июля 2011 года ФЗ-218 «О внесении изменений в ФЗ «О государственном регулировании производства и оборота этилового спирта, алкогольной и спиртосодержащей продукции».
Общественникам известно как минимум о 18 таких административных делах только в Центральном районе Волгограда. В случае, если мировые суды согласятся с доводами надзорного органа, то индивидуальным предпринимателям грозит штраф в размере пяти тысяч рублей, ООО – 30 тысяч рублей.
«Опора России» заявляет, что все эти проверки и административные дела преждевременны. Защитники малого бизнеса утверждают, что те нормы ФЗ-218, которые нарушают предприниматели, еще не вступили в законную силу. «Продажа алкоголя на остановках действительно запрещена. Однако пиво будут считать алкоголем только с первого июля 2012 года. Так, по крайней мере, гласит п.3 ст.1 ФЗ-218. Тогда почему прокуратура раньше времени начала нападать на малый бизнес?», - удивляется Лариса Мельникова.
По словам общественницы, не внесены в связи с принятием федерального закона еще и соответствующие поправки в российский кодекс административных правонарушений. Прокуратуру Волгограда, отмечают в «Опоре России», это не смутило - дела возбуждаются по ч.3 ст.14.16 КоАП РФ – «Нарушение ИНЫХ правил розничной продажи алкогольной и спиртосодержащей продукции».
Отметим, еще месяц назад волгоградские опоровцы, предвосхитив возможные проблемы торговцев с надзорными и правоохранительными органами, обратились за толкованием июльского закона в прокуратуру Волгоградской области, комитет по предпринимательству облдумы, вице-губернатору Василию Галушкину и департамент потребительского рынка мэрии Волгограда. Общественники попросили четко разъяснить: с какого числа следует считать пиво алкоголем, какие законодательные акты будут использоваться для применения санкций в отношении предпринимателей, что следует считать «остановочным пунктом» (формулировка ФЗ-218, - прим. ИА «Высота 102») и пр. Установленный законом срок, то есть месяц, на ответ истек. Однако, как утверждают общественники, ни одного ответа они не получили. Коммерсанты предполагают, что органы власти могут быть не уверены в своей правоте, а потому не спешат разъяснять закон.
Конкретизировать ФЗ-218 призван аналогичный закон Волгоградской области, который сейчас находится на стадии рассмотрения в областной думе. Однако документ , по информации общественников, парламентарии примут уже в 2012 году.Источник: http://v102.ru/news/30825.html
